Terms of Service

1. Acceptance of terms

By accessing or using FashionDraw.ai ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access to your account.

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement.

3. Your content and intellectual property

By uploading content to FashionDraw, you grant us a limited license to process and store that content solely for the purpose of providing the Service to you. This license does not extend to using your content for any other purpose, including AI model training.

You represent that you have the right to upload any content you submit and that doing so does not violate any third-party rights.

4. Privacy and data access

The only circumstances under which FashionDraw might access your content are: (1) at your explicit request for support, or (2) when a critical software error requires investigation. Any such access is limited to what is strictly necessary.

5. Acceptable use

You agree not to use the Service to:

• Upload content that infringes on the intellectual property rights of others
• Generate content that is illegal, harmful, or violates applicable law
• Attempt to reverse engineer, hack, or disrupt the Service
• Use automated tools to scrape, crawl, or overload the Service
• Impersonate any person or entity
• Upload malware or malicious code

We reserve the right to suspend or terminate accounts that violate these rules.

6. AI-generated content

FashionDraw uses AI models to generate content. AI-generated outputs may occasionally be unexpected, imperfect, or unsuitable for your needs. You are responsible for reviewing and validating any AI-generated content before commercial use.

We do not warrant that AI-generated designs are free from similarity to third-party intellectual property. It is your responsibility to ensure generated content does not infringe on third-party rights before use.

7. Payments and subscriptions

Paid plans are billed in advance on a monthly or annual basis. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are provided at our discretion for unused portions of billing periods in cases of service outages or errors.

We reserve the right to change pricing with 30 days' notice to existing subscribers.

8. Service availability

We aim to provide reliable service but do not guarantee 100% uptime. We may occasionally take the Service offline for maintenance, and we will provide advance notice where practicable.

9. Limitation of liability

To the maximum extent permitted by law, FashionDraw is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the three months prior to the claim.

10. Governing law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands, unless applicable consumer protection laws in your jurisdiction provide otherwise.
